Terms of Service

Plain about what tebChart is: an organizing tool you control. It is not your doctor, not a medical record, and not an emergency service.

TebScribe LLC · Effective October 10, 2026 · Applies to the tebChart apps for iPhone and Android, tebchart.com, and any tebChart feature that lets you share or receive information.

The short version

  • tebChart is an organizing tool. It is not medical care, and using it does not make anyone at TebScribe your doctor.
  • If something might be an emergency, call 911 or your local emergency number. Do not wait on the app.
  • Your records stay on your device, or in your own iCloud if you turn that on. TebScribe does not hold them and cannot recover them.
  • You are responsible for what you enter, share, and do with tebChart. That includes what you send to family and anyone else.
  • Use it lawfully and respectfully. The Acceptable Use Policy in section 6 explains what is not allowed.
  • Disputes go to individual arbitration, not court or class actions. You can opt out within 30 days (section 15).

1. Who we are and what you are agreeing to

tebChart is published by TebScribe LLC ("TebScribe", "we", "us"). These Terms of Service ("Terms") are a binding agreement between you and TebScribe. They cover the tebChart apps, tebchart.com, and every tebChart feature, together called the "Service".

You accept these Terms by installing, opening, or using the Service. If you do not agree, do not use it.

These Terms incorporate the following, which together form the whole agreement:

  • the Acceptable Use Policy (section 6);
  • the Medical and Other Disclaimers (sections 2, 3 and 13);
  • our Privacy Policy at tebchart.com/privacy.

Apple and Google.

  • iPhone: your licence to install and run the app is Apple's Standard End User Licence Agreement. Where Apple's licence and these Terms differ on that licence, Apple's controls. These Terms govern everything else.
  • Android: you must also follow the Google Play Terms of Service.
  • The stores are not parties: Apple and Google are not parties to these Terms and are not responsible for the Service. Section 17 has the Apple-required terms.

2. tebChart is not medical care

2.1 No medical advice. tebChart helps you organize and share health information that you enter, scan, import, or receive. It does not provide medical advice, diagnosis, treatment, triage, or prescribing. It does not decide how urgent anything is. Nothing in the Service, its content, or its outputs is a recommendation to start, stop, or change any medication or treatment.

2.2 Not a medical device. tebChart is not a medical device and has not been cleared or approved by the FDA or any other regulator.

2.3 No doctor–patient relationship. TebScribe was founded by a licensed emergency physician. Neither that physician nor anyone else at TebScribe is acting as your doctor or your family member's doctor in any of these settings:

  • using the Service;
  • reading our website, app content, posts, or videos;
  • receiving a promo code;
  • messaging, emailing, or direct-messaging us on any platform, including LinkedIn, Facebook, or other social media.

None of these creates a doctor–patient, nurse–patient, pharmacist–patient, or any other professional or fiduciary relationship. Do not send us health questions expecting medical answers. We will not provide them.

2.4 Not a medical record. tebChart is not your hospital's or clinic's official medical record. It is not a substitute for any of the following:

  • your physician, nurse, or pharmacist;
  • emergency services;
  • a qualified medical interpreter.

2.5 Emergencies. If you think you or someone else may be having a medical emergency, call 911 or your local emergency number immediately. Never delay or skip care because of anything the Service showed, missed, reminded, failed to remind, translated, or summarized.

2.6 Always verify. Before relying on information in tebChart for any decision, check it against:

  • your original paperwork;
  • your medication labels;
  • your care team's instructions.

3. Accuracy, automation and features that can fail

3.1 Automated tools make mistakes. tebChart uses automated and on-device tools for the following tasks:

  • reading paperwork, labels, and lab reports (text recognition);
  • importing records, including from Apple Health or a pasted Family Care Update;
  • translating text;
  • summarizing information, which may use Apple Intelligence or similar on-device features;
  • comparing lab values or noting trends.

These tools can misread, omit, duplicate, mistranslate, or mis-summarize. We do not warrant that any scan, import, translation, summary, trend, reminder, alarm, sync, export, or shared update is complete, current, or correct.

3.2 Reminders and alarms can fail. Reminders and alarms depend on your device, its settings, battery, operating system, and focus modes. Do not rely on tebChart as your only safeguard for a critical medication or appointment.

3.3 Translations are a communication aid only. They are not certified or medical-grade translations. For clinical communication, use a qualified medical interpreter.

3.4 Lab values and trends. Lab values and trend notes help you prepare questions for your care team. They do not interpret results. Reference ranges vary by laboratory.

4. Your data, your device and your responsibility

4.1 Where your data lives. Your records are stored on your device. If you turn on iCloud sync or family sharing on iPhone, they are also stored in your own iCloud account, which Apple operates. TebScribe does not run a server that holds your tebChart records. See the Privacy Policy.

4.2 Backups and loss. Keep your own backups. TebScribe cannot recover your data because we do not have it. Your records can be permanently lost in any of these cases:

  • you lose, reset, or replace your device;
  • you delete the app;
  • you lose access to your iCloud or Google account;
  • you stop sharing, or a sync conflict occurs.

4.3 Content you enter is yours, and so is responsibility for it. You are solely responsible for the information you enter, import, export, sync, or share ("Your Content"). You confirm that you have the right to use Your Content as you do.

4.4 Records about other people. If you keep or share records about another person, you confirm that you have their permission or the legal authority to do so. That person may be a parent, spouse, child, or someone in your care. Authority can come from guardianship or a healthcare power of attorney. You are responsible for respecting that person's privacy and complying with the law.

5. Sharing with family and others

5.1 You choose what is shared. tebChart can create Family Care Updates, ER cards, registration packets, PDFs, and calendar events. It can also open messaging apps such as Messages, WhatsApp, or Telegram with an update ready to send. Some versions include a shared family chart through iCloud and a way to paste in an update someone sent you. Nothing is sent until you choose to send it, and you choose the recipients.

5.2 Once shared, it is out of our hands. Shared information may be copied, forwarded, stored, or misread by recipients or by the messaging service. TebScribe does not control and is not responsible for any of the following:

  • who receives what you share;
  • what recipients do with it;
  • the privacy practices of Apple, Google, Meta (WhatsApp, Messenger), Telegram, or any other service you use to share.

5.3 Shared and imported charts. A chart you receive from someone else reflects what that person entered and chose to share. It may be incomplete, out of date, or wrong. Verify it with the patient's care team. If you are given edit access to a shared chart, you are responsible for your changes. The chart's owner can stop sharing at any time, and you may then lose access to it.

5.4 Family disagreements are not ours to resolve. TebScribe is not a party to disputes between family members, caregivers, or anyone else. This includes disputes about who may see, share, or change a person's information. We do not mediate them and are not liable for them.

6. Acceptable Use Policy

You may use tebChart only for lawful, personal, non-commercial organization of health information for yourself or for people you are authorized to help. You must not:

  1. Break the law. Do not use the Service to violate any law or regulation, or anyone's rights, including privacy, health-privacy, consumer-protection, and intellectual-property law.
  2. Use others' information without authority. Do not enter, share, or import another person's health information without their consent or legal authority. Do not use the Service to stalk, track, or monitor anyone without their permission.
  3. Harass or harm. Do not use the Service or anything it produces to harass, threaten, intimidate, shame, defame, blackmail, or discriminate against anyone. That includes patients, family members, clinicians, and TebScribe staff.
  4. Impersonate or mislead. Do not pose as a clinician, hospital, pharmacy, insurer, or another person. Do not change, fabricate, or forge medical documents, prescriptions, test results, or care instructions. Do not present tebChart output as an official medical record, prescription, or physician's statement.
  5. Misrepresent tebChart or TebScribe. Do not claim that tebChart or TebScribe diagnosed, treated, advised, endorsed, or approved anything. Do not use our name, logo, or the founder's name or image to suggest an endorsement or relationship that does not exist.
  6. Use it commercially without a written agreement. That includes running a clinic, care agency, or business on the Service, reselling or sublicensing it, or using it to provide services to paying clients.
  7. Abuse promotions. Do not sell, trade, or publish promo codes. Do not create multiple identities to obtain codes or free plans. Do not get around purchase limits or payments.
  8. Attack or copy the Service. This covers:
    • reverse engineering, decompiling, or disassembling the Service except where the law expressly allows it;
    • getting around security, App Lock, or licensing;
    • probing, scanning, overloading, or disrupting our website or any relay;
    • scraping;
    • building a competing product from our software, content, or design.
  9. Upload harmful or unlawful content. No malware, and no content that is unlawful, sexually exploitative, or infringes someone else's rights.
  10. Use it for high-risk decisions it is not built for. For example:
    • as the only system for a hospital, nursing home, or clinical workflow;
    • for insurance, employment, credit, immigration, or legal decisions about another person;
    • to train AI models on data you exported from others without their consent.
  11. Abuse our people. Do not send threatening, abusive, or harassing messages to TebScribe, its founder, or its staff, on any channel. We may block, report, and refer such conduct to law enforcement.

Enforcement. If we believe you have broken this policy, we may take any of these steps without notice:

  • refuse support;
  • revoke promo codes or promotional plans;
  • block access to our website or relays;
  • report the conduct to Apple, Google, or law enforcement;
  • take any other step the law allows.

Paid purchases are handled by Apple or Google under their refund rules (section 8).

7. Age and eligibility

You must be 18 or older, or the age of majority where you live, to accept these Terms. A minor may use tebChart only with the involvement and consent of a parent or legal guardian, who accepts these Terms on the minor's behalf and is responsible for that use.

8. Free plan, Premium, Lifetime and promo codes

8.1 Plans.

  • Free: includes one full chart, medications, reminders, appointments, the ER card, and a monthly scan allowance.
  • Premium: an auto-renewing subscription that adds the features shown in the app.
  • Lifetime: a one-time purchase of those Premium features.

Privacy, App Lock, the ER card, and safety features are never behind a paywall.

8.2 Billing, renewal and cancelling. Apple or Google processes and bills every purchase. Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the period ends.

  • iPhone: cancel in Settings › your name › Subscriptions.
  • Android: cancel in Google Play › Payments & subscriptions.

Deleting the app does not cancel a subscription.

8.3 Refunds. Refunds are requested from Apple (reportaproblem.apple.com) or Google under their policies. TebScribe cannot issue App Store refunds or Google Play refunds.

8.4 Promo codes.

  • Codes are a courtesy and have no cash value.
  • Codes may carry an expiry date and limits.
  • Codes may be withdrawn for misuse.
  • Codes cannot be resold.
  • Getting a code does not create any other relationship with TebScribe (section 2.3).

8.5 Lapsed plans. If a paid plan ends, what you already saved stays readable on the free plan.

9. Changes to the Service and to these Terms

We may add, change, or discontinue features, allowances, or platforms. If a change materially reduces what a paid plan includes, we will tell you in advance so you can cancel.

We may update these Terms. For material changes we will tell you in the app or on tebchart.com before they take effect. Continuing to use the Service after the effective date means you accept the update.

10. Intellectual property and feedback

The Service is licensed to you, not sold. That includes tebChart's name, logo, design, software, text, and videos. TebScribe owns them.

You receive a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, under these Terms and the app-store rules.

Your Content remains yours. If you send us suggestions or feedback, we may use them without any obligation to you.

11. Third-party services

The Service works with services we do not operate or control. These include:

  • Apple: iCloud, CloudKit, Apple Health, Translation, and Apple Intelligence;
  • Google;
  • Meta: WhatsApp and Messenger;
  • Telegram;
  • your carrier;
  • the messaging apps you choose.

Their terms and privacy policies apply to how you use them. TebScribe is not responsible for their availability, security, or conduct.

12. Ending your use

You can stop at any time by deleting the app (see tebchart.com/data-deletion). We may suspend or end your access to our website, relays, promotions, or support if:

  • you break these Terms;
  • we must do so by law;
  • the Service is being abused or attacked.

Sections 2–6, 10–16, and 18 survive termination.

13. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. This includes any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, or uninterrupted, timely, secure, or error-free operation. TebScribe does not warrant that the Service will meet your needs, prevent any health outcome, or that any data will be preserved. You use the Service at your own risk and are solely responsible for decisions you make with it.

14. Limitation of liability

14.1 Excluded damages. To the fullest extent permitted by law, TebScribe LLC, its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. They will also not be liable for any of the following:

  • personal injury or health outcome arising from reliance on the Service, a missed or late reminder, a misread scan, a translation, a summary, or shared or imported information;
  • lost or corrupted data;
  • a family or caregiver dispute;
  • anything a third party did with information you shared.

This applies whatever the legal theory, including contract, tort, negligence, or strict liability, and even if we were told such damages were possible.

14.2 Cap. Our total liability for all claims relating to the Service is capped at the greater of:

  • what you paid for tebChart in the 12 months before the claim; or
  • US$50.

14.3 Where the law does not allow this. Some jurisdictions do not allow some of these exclusions, so they may not fully apply to you. Nothing in these Terms limits liability that the law does not allow to be limited, such as liability for fraud or, where required, gross negligence or death or personal injury caused by negligence.

14.4 Time limit. You must bring any claim within one (1) year after it arises, or it is permanently barred, to the extent the law allows.

15. Disputes: informal resolution, arbitration and class-action waiver

15.1 Talk to us first. Before starting any formal proceeding, send a written notice to support@tebscribe.com with the subject line "Legal notice" describing the issue and what you want. We will try in good faith to resolve it within 60 days.

15.2 Binding individual arbitration (US users). If the dispute is not resolved, you and TebScribe agree to resolve it by binding individual arbitration, not in court.

  • The arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules.
  • It takes place in the county where you live, or by video or written submission.
  • There is no judge or jury.

Either side may instead bring an individual claim in small-claims court. Either side may ask a court for an injunction over intellectual-property misuse or a violation of the Acceptable Use Policy.

15.3 No class actions. You and TebScribe may bring claims only individually, not as a plaintiff or class member in any class, consolidated, or representative action.

15.4 Opt-out. You may opt out of this arbitration section within 30 days of first accepting these Terms by emailing support@tebscribe.com from any address, with your name and the words "arbitration opt-out".

15.5 Outside the US. If you live outside the United States, the mandatory consumer-protection law of your country of residence applies where it gives you rights that these Terms cannot override.

16. Your responsibility for claims (indemnity)

To the extent the law allows, you will defend, indemnify, and hold harmless TebScribe LLC and its owners, officers, employees, and contractors from any third-party claim, loss, or cost (including reasonable legal fees) arising from any of the following:

  • Your Content;
  • your sharing of information about yourself or another person;
  • your breach of these Terms or the Acceptable Use Policy;
  • your violation of anyone's rights or of any law.

This section does not apply to a consumer where local law forbids it.

17. Apple-required terms (iPhone)

  • The parties: these Terms are between you and TebScribe only, not Apple. TebScribe, not Apple, is responsible for the app and its content.
  • Licence: your licence is limited to Apple-branded devices you own or control, as the App Store Terms of Service allow.
  • Support: Apple has no obligation to provide maintenance or support.
  • Warranty: if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation.
  • Claims: Apple is not responsible for claims relating to the app, including product-liability, legal-compliance, consumer-protection, or privacy claims.
  • Intellectual property: Apple is not responsible for third-party intellectual-property claims about the app.
  • Legal status: you confirm that you are not located in a country under a US government embargo or designated as "terrorist supporting", and that you are not on a US prohibited or restricted parties list.
  • Third-party beneficiaries: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. General

  • Governing law. The laws of the State of New York govern these Terms, without regard to conflict-of-laws rules, subject to section 15.5.
  • Venue. For any matter not in arbitration, the venue is the state or federal courts located in the State of New York.
  • Severability. If any part of these Terms is unenforceable, the rest stays in effect, and that part is enforced to the maximum extent allowed.
  • No waiver. If we do not enforce a term, we have not waived it.
  • Assignment. You may not transfer these Terms. We may transfer them in a merger, acquisition, or sale of assets.
  • Entire agreement. These Terms, the Privacy Policy, and the app-store terms named above are the whole agreement about the Service.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control. Examples include platform or carrier outages, operating-system changes, and natural disasters.
  • Notices. We may give notice in the app, on tebchart.com, or by email if you have written to us.
